Definitions
“AHRI” - Australian Human Resources Institute Ltd (ABN 44 120 687 149)
“Advertisers” – any person or organisation placing an advertisement on any of AHRI’s e-services
“Users” – all users of AHRI e-services sites, including advertisers and unregistered visitors to any of the AHRI e-services sites.
“AHRI e-Services” – any AHRI-owned web service, including ahri.com.au
1. COPYRIGHT AND TRADEMARKS
All intellectual property rights (including future copyright) in the information and other material appearing on AHRI e-services vests in and is the exclusive property of AHRI and its authorised suppliers. If AHRI permits you to advertise or post on its e-services you grant the Company an irrevocable, permanent and royalty-free licence to use any advertisement that has been submitted by you for placement on AHRI e-services or any other medium owned by AHRI.. You may not and must not allow or permit other parties on your behalf to copy advertisements, or to undertake site scraping or other similar activities unless you have obtained the prior permission from AHRI.
2. LEGAL JURISDICTION
AHRI e-Services are controlled by AHRI and by accessing them you accept that accept that any disputes arising out of your use of these or its contents, as well as terms governing your use and membership shall be governed by the courts having jurisdiction in the State of Victoria in Australia in accordance with the laws in force in the State of Victoria in Australia. These services may be accessed throughout Australia and overseas. AHRI makes no representation that the material on these services complies with the laws of any country outside Australia. If you access these services from outside Australia you are responsible for ensuring compliance with all applicable laws in the place where you are located.
3. PRIVACY POLICY
Personal data will be handling in accordance with AHRI’s privacy policy.
4. ACCEPTABLE USE
4.1 ahri.com.au
Certain sections of ahri.com.au are restricted to AHRI members and students of AHRI courses. AHRI reserves the right to designate pages as member-only.
4.1 HRConnect
HRConnect is a discussion forum provided for: AHRI members to discuss issues related to human resources and people management; interested parties to read those discussions; advertisers carefully selected by AHRI to advertise goods and services relevant to its members.
By posting on HRConnect forums and discussion pages you agree to abide by the talk policy<link> and undertake not to post defamatory or libellous material; material subject to any copyright other than your own; or material which may be in breach of obscenity, anti-discrimination or other legislation.
Users undertake not to use the site for advertising and promotional purposes other than those agreed to and sanctioned by AHRI.
You undertake not to harass, discriminate against or otherwise mistreat other users and agree that any personal information they provide may not be further disseminated with their approval.
You agree that any information you post on the forum will be true and correct to the best of your knowledge at the time of posting.
4.2 HRBizlist
HRBizlist is provided for the purpose of introducing companies and organisations to individuals and organisations that may require their services. All users agree to refrain from using information posted on the site to send unsolicited communications other than for those purposes.
Advertisers agree that any information posted on HRBizlist or will be true and correct at the time of posting and accept responsibility for any incorrect information.
Advertisers agree that any information posted will not be in breach of copyright, obscenity, anti-discrimination and other legislation, and agree not to post potentially or actually defamatory or libellous material, or publish information that may be misleading.
4.3 HRCareers
HRcareers exists to allow organisations, or their authorised representatives, to advertise job opportunities and for job seekers to apply for those jobs. In addition, HRcareers allows job seekers to post their CV and allow it to appear in search results for organisations searching for a candidate with appropriate skills. Users may choose to allow organisations to contact them as a result of these searches. All users agree not to use the site of other purposes and agree not to send unsolicited information other than for the purposes outlined.
Advertisers agree that any information posted on HRCareers or will be true and correct at the time of posting and accept responsibility for any incorrect information.
Advertisers agree that any information posted will not be in breach of copyright, obscenity, anti-discrimination and other legislation, and agree not to post potentially or actually defamatory or libellous material, or publish information that may be misleading.
Advertisers agree that only one position may be advertised per advertisement, except where multiple appointments will be made with the same job title, job description and responsibilities and salary, less any regional adjustments
Advertisers agree they will not perform any refresh or reposting of advertisements purely for the purpose of restoring those advertisements to the top of any search listings.
5. LIABILITY
5.1 Accuracy of information
All information on AHRI e-services is provided ‘as seen’ and AHRI accepts no liability for loss or damage caused as a result of reliance on information posted on any AHRI online service, whether that information has been posted by AHRI or by an advertiser or user of AHRI e-services.
AHRI accepts no liability for damages incurred as the result of inadequate, late or missing service from any advertiser on any AHRI online service.
5.2 Indemnity
Users will at all times indemnify and will continue to indemnify, hold harmless and defend AHRI, its related bodies corporate and their respective personnel from and against all liabilities, costs, damages, expenses, claims, suits, allegations and demands, including, without limitation, all legal fees (incurred on a solicitor and own client basis), arising out of or in relation to:
(a) any infringement, or claim or allegation of infringement, of the intellectual property rights or any other proprietary rights of a third party; and
(b) any fraud, deliberate or wilful misconduct or negligence or breach of these terms and conditions committed by users.
5.3 Availability of service
AHRI provides its e-services on an ‘as and when available’ basis and makes no guarantee as to the availability or performance of the sites. Where a link appears to an external website maintained by a third party, AHRI gives no endorsement as to the services operated by those websites.
5.4 Security
AHRI will take all reasonable steps to maintain the security of information provided by advertisers and users of the site but will not accept responsibility for breaches of security or unauthorized access that arises as a result of disclosure by Users of their login details. Users remain responsible at all times for maintaining the confidentiality of your login details, username and password and AHRI accepts no liability for the misuse of these details.
While AHRI also takes reasonable steps to ensure its e-services are virus free, users acknowledge that they access the services at their own risk and that AHRI is not responsible for any damages caused as a result of accessing AHRI’s services. This includes, but is not limited to, any monetary or other loss that may result from loss or corruption of data, downtime or hardware damage.
5.5 Links to other websites
This site may contain links or other references to other parties and their websites. AHRI cannot control the contents of those other sites, and makes no warranty about the accuracy, timeliness or subject matter of the material located on those sites. AHRI does not necessarily approve of, endorse or sponsor any content or material on those sites.
AHRI makes no warranties or representations that material on other websites to which this website is linked does not infringe the intellectual property rights of any person anywhere in the world.
AHRI is not, and must not be taken to be, authorising infringement of any intellectual property rights contained in material on other sites by linking to them from this website.
6. RIGHT OF REFUSAL
In the event that you breach any of these conditions AHRI reserves the right to refuse publication or to remove from the public domain any posting, advertisement or comment on any AHRI online service at any time without prior notice, and where payment has already been made to withhold from refund an amount equivalent to any costs incurred and/or service already supplied.
7. PAYMENT
Payment for services supplied by AHRI must be made in accordance with the terms stated on the payment page, or in accordance with any separate agreement entered into.
8. SUSPENSION
AHRI reserves the right to remove service, cancel user accounts and remove from e-services sites any posts in the event of any breach of this agreement, non-payment for services, breach of the talk policy or conduct which is likely to be detrimental to the good name of AHRI and its members.
